Scope of Application
For the business relationships between Rally and Racing WebShop, A. Galitzki & D. Klein GbR, Hauptstr. 172, 51143 Cologne, Germany and the customer, these general terms and conditions of business (GTC) apply exclusively. Conditions standing in opposition to or deviating from these GTC are not recognized by RWS, and such conditions are herewith controverted explicitly by RWS. The customer’s opposing terms and conditions are only valid, when RWS explicitly agrees to these in writing.
Time of Contract Conclusion
By clicking on the "submit order" button, you are placing a binding order for the goods contained in the shopping cart. The confirmation of the received order occurs immediately following the sending of the order. The contract of sale is either the result of our confirmation of delivery or the delivery of the goods.
Access to the Contractual Text
The text of the contract is saved. You have access to the general conditions of the contract at all times on the "General Terms and Conditions" page.
Please, see the product description for the expected delivery time. When no such information is found there, then the delivery takes place within 30 days of receiving the order. Longer delivery times are possible upon request.
We reserve the right to carry out partial deliveries. Additional shipping costs only result from explicit agreements.
Right of Withdrawal
You can revoke your contractual agreement within fourteen days. The withdrawal must not contain any reason.
The period of withdrawal has fourteen days and begins from the moment the recipient of the order receives the last good of the order.
In order to withdraw your contractual statement, you must send us (A.Galitzki & D.Klein GbR, Rally and Racing Webshop, Hauptstr. 172, 51143 Köln, Germany, tel: +49 (0)2203 9242570, fax: +49 (0)2203 9242590, email: firstname.lastname@example.org) a written statement (e.g. letter, fax, email) about your decision to withdraw your contractual agreement. To do so, you can use our sample of return form.
The withdrawal period shall be deemed observed if the statement of withdrawal is sent within this period.
Effects of the withdrawal
If you withdraw your contractual agreement, we have to refund the cost of your order, including shipping (excepted the extra costs of a shipment done with another shipping service as our standard cheapest shipping service). The refund must happen within a period of fourteen days after we received your statement of withdrawal. We will use the same payment method for the refund as for the original payment, excepted if something else as been formally agreed with you. We will not ask you for any fee for the refund of your order. We can refuse to refund the order as long as we haven't received the returned goods or as long as we haven't received any proof of their return from you.
The goods must be sent back or brought back to us within fourteen days after that we received your written statement about your decision to withdraw your contractual agreement with us. The withdrawal period shall be deemed observed if the goods are returned within this period. You bear the costs of the return of the goods.
In the event of a loss in value of the good, you will be liable to pay an indemnification only if the deterioration of the good is attributed to another use as the inspection of the condition, quality and functionality of the good.
The warrenty by law applies for all products in our shop.
We retain ownership of the goods until full payment has been received.
The place of jurisdiction for all legal disputes resulting from this contract is Cologne, Germany, excepting when the customer is a consumer.
